Butte man wants arson guilty plea withdrawn
A Butte man sentenced to a minimum of three years with the Department of Corrections and ordered to pay $50,000 in damages after pleading guilty to felony arson and accountability is appealing to the Montana Supreme Court.
The Montana Standard reports (http://bit.ly/10FELlQ) that 32-year-old Jeffery Mizerski filed the notice of appeal last week to get his guilty plea withdrawn.
Mizerski pleaded guilty in May 2012 to helping start the fire that led to residents being evacuated from the National Hotel building and the historic building eventually razed.
In November his request to withdraw the guilty plea was denied by District Judge Brad Newman who ruled Mizerski was fully aware when he made the choice to plead guilty.
