Lolo shot in head charged with burglary, assault

MISSOULA, Mont. -

Missoula County authorities have charged a Lolo man who was shot in the head after entering another man's trailer and allegedly threatening him.
    
Documents filed by Assistant Chief Deputy County Attorney Jennifer Clark charge 38-year-old Ben Brooks McGraw with burglary and assault.
    
Clark's affidavit says McGraw entered the other man's trailer without warning, shoved the man, pushed him into a mirror and threatened to beat him up.
    
Police have described the homeowner as a 55-year-old man. Clark says the homeowner was concerned for his safety because of health issues so he grabbed and .22-caliber pistol and told McGraw to leave.
    
The Missoulian reports McGraw allegedly raised his fists and again went after the man, who fired a single shot.
    
The affidavit says alcohol may have been a factor.
