Man charged with negligent homicide in fatal crash
A 22-year-old Wolf Point man is charged with negligent homicide for an Interstate 94 crash this summer that killed a passenger.
The Billings Gazette reports (http://bit.ly/R0Gfl3 ) Justino Jason Hernandez is charged in the death of 21-year-old Kevor Martell. Hernandez also is charged with negligent vehicular assault for injuries suffered by 21-year-old Alexander Bar in the crash shortly before midnight on Aug. 7.
Court records say Hernandez told a Montana Highway Patrol trooper that Martell asked to use his cellphone. He said the phone was locked, so Martell took the steering wheel while Hernandez entered his password. The vehicle drifted into the median. Hernandez said he took the wheel and overcorrected, causing the car to roll.
Witnesses told investigators they saw Hernandez's vehicle speeding without working headlights before the crash.
