The 55-year-old man investigators said shot another man after entering his home in Lolo early Sunday morning probably won't face charges.
But the man reported to be in stable condition with a bullet wound above the eye probably will.
Witnesses that NBC Montana talked with, said the 38-year-old Browning man kicked in the door of the older man's 5th wheel trailer, shouted at him, and even threw a large mirror at him.
Investigators said despite repeated requests by the homeowner for the intruder to leave, he didn't.
They said the homeowner told the man he'd shoot him if he didn't go, and the younger man reportedly said go ahead.
Investigators said the man shot him, and with the help of a friend, gave aid to the wounded man until paramedics arrived.
"People have a right to defend themselves in their homes," said Missoula County Sheriff's Department spokesman Jason Johnson, "and that appears to be what the situation was."
But the man who was shot could face criminal trespass and burglary charges.
Neither of the mens names have been released.
