Evergreen man gets 5 years for fatal fight

KALISPELL, Mont. -

An Evergreen man who pleaded guilty to negligent homicide in the death of another man during a drunken fight last June has been sentenced to 15 years with the Department of Corrections with 10 suspended.
    
The Daily Inter Lake reports District Judge Ted Lympus on Wednesday gave 55-year-old David Day the sentence recommended by prosecutors in the October plea agreement over the death of 55-year-old Gerald Payne.
    
Prosecutors say Day and Payne spent most of June 1 drinking at Day's apartment and both became extremely intoxicated. Charging documents say the men fought and Day hit Payne in the face, causing him to fall down a flight of stairs.
    
Deputy Flathead County Attorney Travis Ahner recommended that Day participate in chemical dependency treatment as part of his sentence.
