Home invasion suspect out of hospital, in jail

MISSOULA, Mont. -

The man who took a bullet to the stomach during a Missoula home invasion faced a judge Monday.

22-year-old Dillon Torey Franklin from Arkansas, appeared in Missoula County Justice court just over a week after prosecutors say he broke into a 77-year-old man's home on the north side of town.

The court documents say the homeowner told Franklin to leave and warned him he had a gun, but when he didn't leave the homeowner shot him.

Franklin is charged with felony burglary, criminal mischief, criminal trespass to vehicles and disorderly conduct for the crime.

Justice of the Peace Mike Frellick set bail at $100,000.
