Kalispell man pleads guilty in drunk driving crash that killed 2

A Kalispell man has pleaded guilty to killing two men in a drunk driving crash that occurred on Highway 93 South of Kalispell on the evening of October 17, 2013.
Joseph Leroy Powell appeared in Flathead District Court with his left arm, broken in the crash, still in a sling.
He offered the open guilty plea to both charges of vehicular homicide while under the influence, without the benefit of a plea agreement. Powell’s lawyer indicated that Powell had every intention of taking responsibility for his actions from the very beginning of the case.
The driver of the vehicle Powell hit head-on, Brian Delaney, 43, of Kalispell died at the scene. Powell’s passenger, Patrick Moulton, also 43 and from Kalispell, was transported to Kalispell Regional Medical Center where he later died of his injuries.
The case is set for sentencing in May, and without a plea agreement prosecutors will be free to argue for the maximum sentence, 30 years in Prison and a $50,000 fine for each charge.
