Missoula man charged with felony after allegedly assaulting younger brother

MISSOULA, Mont. -

A judge released a Missoula man from jail but told him he can't have any contact with his younger brother after he allegedly choked him.

21-year-old Merle James Spooner is charged with felony aggravated assault. Court documents say he went in to his 15-year-old brother’s room late Saturday night while his brother was asleep and started punching him.

The younger brother told police that eventually Spooner put him in a choke-hold to the point where he couldn't breathe and he thought Spooner was going to kill him.

In Missoula County Justice Court Monday, the judge told Spooner he could be released from jail without posting bail, but he’s not allowed to have any contact with his brother.
