MSU attorneys ask that lawsuit be dismissed

BOZEMAN, Mont. -

Attorneys for Montana State University are asking a federal judge to dismiss a lawsuit filed by a former student who claimed a music professor raped her.

The Bozeman Daily Chronicle reports the school argued Monday the woman's lawsuit raises the same claims she made in Human Rights complaints that she settled for more than $234,000 last year.

MSU's attorney, Andy Forsythe of Billings, said by accepting the offers of judgment from the school and former professor Shuichi Komiyama, she agreed the amount of judgment was sufficient to remedy her complaints.

The woman's Oct. 11 lawsuit seeks damages for negligent hiring, retention and supervision of Komiyama along with assault, battery and infliction of emotional harm. The woman claims both Title IX and civil rights violations.
