New law protects children from drunk drivers

Theresa Birdsley is one of first suspects charged under the new felony law.

Birdsley is accused of transporting a 2-year-old child while driving drunk.

MISSOULA, Mont. -

Missoula prosecutors have charged a St. Ignatius woman under a new state law, protecting children from drunk drivers.

Theresa Birdsley is likely one of the first suspects ever accused under it.

Senate Bill 160 allows that anyone transporting a child under 14 in a motor vehicle, while under the influence, faces a felony.

Police report Theresa Birdsley was weaving along a city street about 4:30 a.m. Wednesday, when she was pulled over.

Detectives said a 2-year-old child was in her car.

She appeared in court, where bail was set at $2,500.
