HAMILTON, Mont. -

A Montana judge has sentenced a Hamilton pastor convicted of securities fraud to 90 days with the Montana Department of Corrections - with weekends off.

A jury convicted Harris Himes in September of fraudulent practices, failing to register a security and failing to register as a security salesperson.

Prosecutors say he cheated a church member out of $150,000 by telling the man the money would be invested in a factory in Mexico that didn't exist.

Himes was sentenced Friday by District Judge Loren Tucker to a 10-year commitment to the Department of Corrections, with all but 90 days suspended.

Himes will be required to serve just five days a week.

But the judge delayed imposing the sentence after Himes said he planned to appeal.
